Welcome to Jhanko. These Terms and Conditions ("Terms", "Agreement") form a legally binding agreement between you ("User", "Customer", "Partner") and Jhanko ("Company", "we", "us", or "our") regarding your use of the Jhanko mobile application, website, and related services (collectively, the "Platform").
By downloading, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
CRITICAL NOTICE: Role of Jhanko as an Intermediary
Jhanko operates strictly as a technology platform and digital intermediary as defined under the Information Technology Act, 2000. We do not own, sell, resell, or provide the retail products, transportation services, or professional services listed on the app. Any contract for sale, transport, or service is strictly a bipartite contract between the Customer and the Partner (Seller/Driver/Service Provider).
1. Account Registration and Types
The Platform serves multiple user personas. When creating an account, you must provide accurate and complete information.
- Customer Accounts: For users browsing and purchasing from local vendors.
- Partner Accounts: For Retailers, Auto Drivers, Service Providers, and Street Vendors offering goods or services. Partners are responsible for ensuring they possess all necessary local licenses, permits, and registrations to conduct their business legally.
You are responsible for maintaining the confidentiality of your OTPs and account access.
2. Zero Commission and Payments
Jhanko currently operates on a 0% Commission model for transactions between Customers and Partners.
- Because we charge zero commission, payments are often settled directly between the Customer and the Partner (e.g., via direct UPI, cash, or third-party payment gateways).
- Jhanko is not responsible for any payment disputes, refunds, or failed transactions between users.
- We reserve the right to introduce fees for premium visibility, advertising ("Growth" tools), or platform maintenance in the future with prior notice.
3. Content Uploads (Video Feeds and Catalogs)
Partners are encouraged to use our visual discovery tools (video feeds and image uploads). By uploading content, you guarantee that:
- You own the rights to the content and it accurately represents the physical product or service.
- The content does not violate any intellectual property rights, decency laws, or community guidelines.
- You grant Jhanko a non-exclusive, royalty-free license to display, optimize, and distribute this content on our Platform for discovery purposes.
4. Prohibited Activities
You agree not to engage in any of the following activities on the Platform:
- Posting fake listings, deceptive pricing, or inaccurate location data (including manipulation of the Thela Tracker).
- Gaming the Open-Bidding mobility system through coordinated price manipulation.
- Uploading explicit, offensive, or illegal video/image content.
- Attempting to reverse-engineer, hack, or scrape data from the Jhanko App.
5. Limitation of Liability
To the maximum extent permitted by law, Jhanko shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Platform. We specifically disclaim liability for:
- The quality, safety, or legality of items sold by Retailers or Street Vendors.
- The behavior, driving safety, or punctuality of Mobility Partners.
- The workmanship or conduct of Service Providers hired through the Digital Labor Chowk.
6. Termination
We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms, receive consistent negative community ratings, or engage in fraudulent activities.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana.
